1. Introduction

The general conditions for using the site www.bg-kayak.com regulate the relations between the users of the site, hereinafter referred to as the User and www.bg-kayak.com, respectively the owner of the site – “Water Horizon OOD.”, hereinafter referred to as the Water Horizon.

“User” within the meaning of these General Terms and Conditions is any private or legal person who visits and / or purchases products from www.bg-kayak.com and uses the resources of the site.

These General Terms and Conditions contain the rules of operation and provide information on how to use the resources of the site by each User. The General Terms and Conditions are valid for each User for the entire period of use of the site – from initial entry to departure, and in case of confirmed order – until its payment, delivery, warranty, complaint, service and expiration of the warranty period of the product.

The links provided on the website www.bg-kayak.com to websites owned by third parties are published solely for the convenience of users. When using such a link, the Users do not use a service provided by Water Horizon and after using the link, these General Terms and Conditions expire.

2. Rights and obligations of the parties

2.1. Rights and obligations of Water Horizon

Water Horizon has the right to change the technology, design, functionality and content of the site and the products and services provided without prior notice.

Water Horizon is not responsible for whether the flow of information to and from the site will not be monitored and / or recorded by third parties. Voden Horizont is not responsible for the information displayed or the consequences of using other websites to which www.bg-kayak.com provides a link.

Water Horizon cannot guarantee constant unimpeded access to the information on the site.

When using www.bg-kayak.com, the User has the right:

• To use the services of Water Horizon in accordance with the requirements of these General Terms;
• To upload, record or print individual parts of the content, but only for non-commercial and personal purposes, provided that it retains all inscriptions related to copyright and other property rights on the content;

Voden Horizont is a registered administrator of personal data according to the Personal Data Protection Act (PDPA) with identification number 253139 and guarantees that the personal data of all Users of www.bg-kayak.com are processed in accordance with the PDPA.

4. Copyright

Water Horizon is not responsible for infringements of copyright and related rights committed by Users, but reserves the right to prevent such actions.

The use of materials published on this site on other sites is prohibited. Voden Horizont reserves the right to assign the rights to publish materials and any parts of the information on the site to third parties in an additional contract governing the rights and obligations in writing.

All goods and services offered by Water Horizon, protected by copyright and related rights, are offered in their original form, packaging and media without any influence by Water Horizon and according to the licenses and distribution rights granted by the producers and / or their distributors for Bulgaria.

Water Horizon reserves the right to use for advertising purposes, exhibitions, demonstrations and more. works of the Users who participated in competitions organized by Water Horizon, after coordination with their authors. The physical media and copies of the works copied for the above purposes remain the property of Water Horizon.

5. Order

The order of products from www.bg-kayak.com is a statement of intent that binds the User and Water Horizon with the force of a contract. Orders can be made only in writing, through the online store available on the site or at [email protected]. For more information, please see contacts.

There is no minimum amount for ordering products from www.bg-kayak.com. Delivery, unless otherwise agreed, is paid by the User. The delivery of a kayak or canoe to Sofia is free.

An order is considered accepted after the User confirms it online and after a consultant of Water Horizon contacts the User to confirm its acceptance. In case a consultant of Water Horizon does not confirm the acceptance of the order, it is considered invalid and accordingly not enforceable.

The indication of incomplete or incorrect data makes the order invalid and it does not bind Water Horizon with execution. In these cases, the person who placed the order is responsible for all costs incurred by www.bg-kayak.com in this regard, including but not limited to any attempted delivery.

Water Horizon is obliged to provide and maintain up-to-date information about the products offered on the site in accordance with the provisions of Art. 52 of the Consumer Protection Act (CPA). Water Horizon does not require and does not accept advance payment before the expiration of the terms (Article 55 of the CPA).

6. Prices and availability of products

The prices announced on www.bg-kayak.com are in Bulgarian levs or Euros per unit. All prices include 20% VAT. When paying in another currency, the costs of all fees for bank transfers are at the expense of the User.

Water Horizon reserves the right to change the prices announced on the site at any time. In case of change of the purchase price the price is in force at the moment of confirmation of the order by the User.

In case of reduction of the prices of specific products on www.bg-kayak.com the provisions of art. 63 and Art. 64 of the CPA.

In case any of the ordered products is not available at the time of the order, a consultant of Voden Horizont will contact the User as soon as possible to specify the expected delivery date or to offer an alternative product. Water Horizon is obliged to observe the terms for execution of the order according to the provisions of art. 58 and Art. 59 of the CPA. Voden Horizont is not responsible if the product is marked at the time of the order as available on the site, but the availability has expired at the time of confirmation of the order by Voden Horizont.

7. Delivery

The products ordered by the User, at his request, will be delivered to the address specified by the User by courier. Depending on the chosen method of payment, the User will receive the ordered products by courier under the following conditions:

• in case of cash on delivery – payment in cash upon delivery on the spot;
• in case of bank transfer or by card – delivery to the place indicated by the user after recording the payment on the account of Voden Horizont
• when buying on credit – after approval of the loan by the credit institution.

Voden Horizont OOD reserves the right to refuse the method of payment by cash on delivery and to insist on payment by invoice if the ordered goods are canoe, kayak or SUP.

 After accepting the order, a consultant from Voden Horizont can contact the User to specify the delivery time.

Delivery is made to the address specified by the User within 4 working days after recording the payment on the account of Water Horizon.

In case the User does not provide access and conditions for delivery of the products to the address indicated by the User, Voden Horizont is released from its obligation to fulfill the requested delivery. In these cases, the User owes Water Horizon payment for the costs incurred for the delivery and return of the products. The above also applies if the consumer has indicated the courier’s office as the delivery address and has not sought the product within 3 days after delivery to the office.

In case the provided by the User delivery address can’t be used or refused by the courier, Voden Horizont will contact the User to negotiate an alternative delivery address.

In the event that a User who ordered products from www.bg-kayak.com remains undetectable to specify the address and delivery time, Water Horizon reserves the right to cancel the order.

According to the CPA, the User has the right within 14 days from the date of receipt of the product to refuse it without paying compensation or penalty and without stating a reason (Article 55, paragraph 1). In this case, Water Horizon undertakes to return the amount received. The cancellation of an order is made in writing by e-mail [email protected]. The amount paid is transferred to the account that the User has used to order the payment after the product is received at the address of Water Horizon, no later than 30 days from the date of exercise of the right of withdrawal.

The returned product is accepted only if it is in a suitable commercial form (“indistinguishable from new”), accompanied by a declaration certifying that the product is in the form in which it was received without being used, the original packaging is intact and all adjoining equipment is available. Voden Horizont warns that in cases where tests are required to determine the condition of the returned product, this may require a delay in the refund, but not more than 30 days from the date of exercise of the right of withdrawal. .

The term for returning the product is not more than 4 working days from the date of the order refusal. The costs of returning the purchased product are at the expense of the User.

According to the CPA, Water Horizon is obliged to fulfill the contract concluded at a distance, not later than 30 days from the date following the sending of the User’s order to Water Horizon by using a means of distance communication, unless the parties have agreed otherwise delivery time (art. 58).

When Water Horizon is unable to fulfill its obligations under the contract due to lack of ordered goods and services, it is obliged to notify the User and refund the amounts paid by the User within 30 days from the date on which Water Horizon followed to fulfill its obligation under the contract (Article 59, paragraph 1 of the CPA).

Water Horizon may deliver to the User goods or services of the same quality and price, when this possibility was explicitly provided for before the conclusion of the contract or in the contract itself. In this case Water Horizon notifies the User in a clear and understandable way about the change in the performance of the contract (Article 59, paragraph 2 of the CPA).

When under the conditions of para. 2 Water Horizon performed otherwise than due and the User exercised his right to withdraw from the contract, the cost of returning the goods is at the expense of Water Horizon, for which the User must be notified (Article 59, paragraph 3 of CPA).

8. Warranty

All new products offered by Voden Horizont and with the respective warranty period determined by their manufacturer and in accordance with the CPA.

Voden Horizont undertakes to perform each warranty repair on the territory of the Republic of Bulgaria in accordance with the warranty conditions below.

With each order for goods subject to warranty service, Voden Horizont issues a proper warranty card with product data and warranty periods.

The guarantee loses validity in:

• Lost warranty card;
• Attempt to repair by an unauthorized service from Water Horizon;
• Damage caused by improper operation;
• Defect caused by external causes, including but not limited to shocks / shocks, dragging, misuse or improper storage, etc .;
• Violation of the physical integrity of the product;
• Chemical, thermal or other effects not related to the normal operation of the product.

In the event of defects within the warranty period, the User must contact the Water Horizon. Warranty service is performed in the presence of complete documentation and equipment of the product – the warranty card, a copy of the purchase document (receipt / invoice) and a description of the defect.

According to Art. 113, para. 3 of the CPA, bringing the consumer goods in accordance with the sales contract is free of charge for the Consumer. It does not incur costs for the shipment of consumer goods or for materials and labor associated with its repair, and must not suffer significant inconvenience.

In case of finding a defective product within 7 days from the date of purchase, Voden Horizont undertakes to replace it with a new one or to refund the funds paid by the User in full, no later than 30 working days from the date of the complaint was made.

The product warranty does not cover cases where the defect is caused by the actions of the User (shocks, shocks, improper storage, improper transportation, wear due to normal operation, etc.) or when there is non-compliance with the manufacturer’s requirements for proper use of the products.

9. Complaint and refusal to receive purchased products

According to the CPA, the complaint of a consumer good can be filed up to two years from the delivery of the goods, but not later than two months from the establishment of the non-compliance with the agreed (art. 126, para 1).

A user who ordered a product through www.bg-kayak.com and received it by courier or other mode of transport has the right to refuse to receive the order or part of it after it has been delivered to the User, only in one of the following cases:

• The product or its packaging is damaged during transportation;
• The pre-agreed delivery time has not been met;
• The delivered product obviously does not correspond to the orders ordered by the customer;
• In this case, the product is replaced within one month from the filing of a complaint by the consumer or the amount paid is refunded if the product is no longer available.
• The price does not correspond to the one originally offered;
• Provided that the product contradicts the general safety requirements within the meaning of the CPA.

If there is a discrepancy between the ordered and delivered product, which was impossible to establish at the time of delivery, the product is replaced within one month from the filing of a complaint by the User and after an inspection to determine the discrepancy (Art. 113 , para 1 of the CPA).

Apart from the listed cases, the customer has no right to refuse to receive and pay for the product ordered by the User. Otherwise, he must pay the delivery costs to the User and return the product back to the supplier.

10. Consent to the General Terms and Conditions

Both parties accept the General Terms and Conditions in full and without exception.

The provisions of the current legislation of the Republic of Bulgaria shall apply to all issues not settled by these General Terms and Conditions.

Parents exercising parental rights, guardians or custodians of a minor or a person under guardianship, are responsible for all damages caused by the same, to Water Horizon and third parties when placing orders offered at www.bg-kayak.com products or when using other services available through the website of Voden Horizont OOD – www.bg-kayak.com
